Official Promotional Rules
WKSM/99ROCK & MILLER LITE “HARLEY DAYS OF SUMMER” Giveaway
A complete copy of these rules can be obtained at the offices of WKSM/99ROCK, 225 NW Hollywood Boulevard, Fort Walton Beach, FL 32548, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
1. No purchase is necessary.
2. Must be at least 21 years of age in order to participate and win.
3. All contests are open to the general public nationwide, except for employees, agents, subsidiaries and affiliates of WKSM/99ROCK, other participating Cumulus stations, Cumulus Broadcasting LLC, Miller Brewing Company, Goldring Gulf Distributing, Harley Davidson, participating sponsors, their immediate families, household members and all other radio industry employees. To be eligible listeners must have a working telephone number; both, when qualifying, and at the time they are selected as a prize winner. Individuals with disconnected phone numbers that have been changed without a forwarding phone number will be bypassed during the random winner selection process.
4. An individual may win an on-going contest only once per 6 month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest. Any individual, who has won a prize / prizes valued at over $600 on any Cumulus Broadcasting station within the past year, will not be eligible.
5. The contest will begin Friday, July 4, 2008, and will run through Wednesday, August 20, 2008.
6. There will be one grand prize: a Harley Davidson XL 1200N Sportster 1200 Nightster Motorcycle valued at approximately $10,000. (Does not include a trailer).
7. Listeners can register for the grand prize by being the correct caller at 850-243-3699 when cued to call. On-air qualification will take place weekdays from Monday, July 7th through Tuesday, August 19th. A total of 42 qualifiers will be determined via on-air qualification. Listeners can also register for the contest by attending any 99ROCK/Miller Harley Party or Van Hit between Friday, July 4th and Sunday, August 17th (dates, times and locations to be announced in advance on the air) and completing the official contest entry form. Only one entry per person per event will be accepted. One (1) qualifier will be selected at each registration event for a total of 15 qualifiers. Customers may also register throughout contest period at any area Miller Lite display located in various retail establishments that sell malt-beverage products. Goldring Gulf Distributing will collect all entry boxes and forms on, or about, August 13th and deliver to 99ROCK/WKSM. From all retail entries collected, a total of 40 qualifiers will be selected at random and contacted by WKSM using the information provided on their entry form. A person may only qualify one time either via on-site registration or on-air. Dates and times of on-site registration remotes subject to change.
8. On Wednesday, August 20, 2008, all qualifiers must attend the 99ROCK & Miller Lite Grand Prize Giveaway at The Swamp, 1450 Miracle Strip Parkway, Fort Walton Beach, FL 32548. Qualifiers must be present and check-in with the 99ROCK representative between 7 and 9 p.m. to remain eligible. Additionally, from 7 to 9 p.m., WKSM/99ROCK will register additional persons for two final qualifiers to be selected at 9 p.m. in a random drawing. A total of 99 qualifiers will be selected from all registration means. Between 9 p.m. and 10 p.m., from all qualifiers present and checked in, WKSM/99ROCK will select nine finalists via random drawing to join them on-stage for a reverse drawing in which the nine finalists names will be “drawn down” and awarded various prizes including the last name selected as the grand prize winner of the Harley-Davidson. The next to the last finalist selected will receive a Harley Davidson/Miller Lite leather jacket valued at approximately $200 as runner-up prize. In some circumstances the Grand Prize winner may be chosen the week before or the week after Wednesday, August 20, 2008. The Winner’s name may or may not be announced on the air.
9. In the event of a tie, the winner will be determined by random drawing or another means deemed appropriate by Cumulus Broadcasting LLC. The Cumulus Broadcasting representative conducting the contest will determine all winners; their decisions and interpretations of these rules shall be final.
10. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize / prizes valued at over $600 will be issued an IRS form 1099 to report their winnings. All those who win a prize / prizes valued at over $600 on any Cumulus Broadcasting station will not be eligible to win a prize / prizes greater than or equal to that value for one year.
11. All prizes are awarded “as is.” Prizes are nontransferable and cannot be exchanged for other trips, prizes or cash.
12. WKSM/99ROCK shall not be responsible for the failure of participating sponsors to deliver prizes as promised.
13. All entrants and winners agree that WKSM/99ROCK, Cumulus Broadcasting LLC, Miller Brewing Company, Goldring Gulf Distributing, Harley Davidson, and their affiliates, and sponsors shall have no liability and shall be held blameless for any injury, misfortune, or damage to either persons or property insured by entering, participating in, winning, or losing any contest by use or non-use of any prize received.
14. All prizes must be claimed in person at WKSM/99ROCK during regular business hours and within ten business days of contact by WKSM/99ROCK that their prize is available for pick-up. After such time, ownership of said prize reverts to Cumulus Broadcasting LLC, to be disposed of at their discretion. The winner then loses all claims and rights to said prize. (Motorcycle will not be delivered to the winner the night of the drawing. After prize acceptance paperwork is completed, the winner will have to pick up the bike at the local Harley dealer. Estimate 4-6 weeks after the finale event.)
15. State issued identification must be presented to claim prize. Winner will be required to fill out a prize fulfillment package within 14 days of winning. This information will be notarized and copies provided to the contest winner, Miller Brewing Company and Cumulus Media corporate office in Atlanta, GA. Winner must show proof of valid vehicle insurance prior to receipt of his/her prize.
16. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the station to be used, disposed of or destroyed at the discretion of the station. Such use including, but not limited to, enrolling entrant in one or more of the station’s listener clubs and sending entrant correspondence and solicitations with regard to such clubs. Further Cumulus Broadcasting LLC is not responsible for lost, mutilated, illegible, misdirected, late, stolen, incorrect or incomplete entries. WKSM/99ROCK and Cumulus Broadcasting are not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website.
17. All winners agree that Cumulus Broadcasting LLC, their affiliates and sponsors may broadcast or publish their name, city of residence, photo, video tape, film or any other likeness, including their voice, recorded or live, for any reason Cumulus Broadcasting LLC, their affiliates and sponsors deems necessary without compensation. All winners will be further required to hold Cumulus Broadcasting LLC, their affiliates and sponsors, blameless and without liability for such publication, broadcast or use.
18. WKSM/99ROCK reserves the right to end a contest at any time upon advanced notice to the public
19. WKSM/99ROCK reserves the right to limit the number of times an individual may enter a contest or drawing.
20. WKSM/99ROCK reserves the right to require contestants or their representative via written proxy to be present at drawings in order to win their prize.
21. Cumulus Broadcasting reserves the right to change any of this promotion and or the promotional elements. Odds of winning are based on the number of entries received.
22. Violations of any of these rules or attempts to win any contest by fraud, deception, or cheating shall be grounds for the station to disqualify that individual from participating in all current and future contests and events at the sole discretion of the station, as well as forfeiture of any prize or prizes won by fraudulent means.
23. A winners list may be obtained after August 20, 2008, by sending a self-addressed stamped envelope to the following address:

25. WKSM/99ROCK will allow proxies for all military qualifiers (those deployed, with stateside duties or obligations which make their attendance for the final drawing unlikely) in the event of a final giveaway party being held in which qualifier presence is required to remain eligible for the trip. In the spirit of fairness, all civilian final qualifiers, who are unable to attend for a verifiable, reasonable, circumstance, will be allowed a proxy. All proxies must be made in advance of the giveaway through the station’s promotion department.

1. HOW IT WORKS: Beginning on or about 07/15/08, residents of FL who are of legal drinking age at time of entry may enter to become a Semi-Finalist in the Miller Lite Better Bolder Summer Sweepstakes.
a. (5) Semi-Finalists will be selected via Rule 2(A).
b. (10) Semi-Finalists will be selected via Rule 2(B).
c. (42) Semi-Finalists will be determined via Rule 2(C).
d. (40) Semi-Finalists will be selected via Rule 2(D).
e. (2) Semi-Finalists will be selected via Rule 2(E).
2. HOW TO ENTER: There are five (5) ways to enter this sweepstakes. You will be entered into the sweepstakes based on the form of entry, limit one winning entry per person:
A. Complete an official entry form or plain piece of 3” x 5” paper, sign your name and also hand print your complete name, address, birth date, email address (optional) and daytime phone number. Deposit your entry in the provided receptacle during on-premise events. Limit one entry per person, per day. Entries must be received prior to the conclusion of the on-premise event to be eligible. No mechanically-reproduced entries permitted. Not responsible for lost, late, mutilated, illegible or incomplete entries. All entries become the sole property of the Miller Brewing Company (“Sponsor”) and will not be returned.
B. Complete an official entry form or plain piece of 3” x 5” paper, sign your name and also hand print your complete name, address, birth date, email address (optional) and daytime phone number. Deposit your entry in the provided receptacle during radio van stop events. Limit one entry per person, per day. Entries must be received by the conclusion of the radio van stop event to be eligible. No mechanically-reproduced entries permitted. Not responsible for lost, late, mutilated, illegible or incomplete entries. All entries become the sole property of the Miller Brewing Company (“Sponsor”) and will not be returned.
C. Starting 07/15/08 through 08/13/08, listen to WKSM for a chance to become a Semi-finalist in the Miller Lite Better Bolder Summer Sweepstakes. Listen for the random prompt to call throughout the day. If you are the designated caller to call provided phone number after the prompt, you will become a Semi-Finalist in the Miller Lite Better Bolder Summer Sweepstakes (subject to verification).
D. Complete an official entry form or plain piece of 3” x 5” paper, sign your name and also hand print your complete name, address, birth date, email address (optional) and daytime phone number. Deposit your entry in the provided receptacle. Limit one entry per person, per day. Entries must be received by 5:00 on 08/13/08 to be eligible. No mechanically-reproduced entries permitted. Not responsible for lost, late, mutilated, illegible or incomplete entries. All entries become the sole property of the Miller Brewing Company (“Sponsor”) and will not be returned.
E. On an official entry form or plain piece of 3” x 5” paper, sign your name and also hand print your complete name, address, birth date, email address (optional) and daytime phone number. Deposit your entry in the provided receptacle during the Grand Prize Miller Lite Better Bolder Summer sweepstakes event on or about August 20, 2008. Limit one entry per person. No mechanically-reproduced entries permitted. All entries must be deposited by the announced time, prior to the finalist event. Not responsible for lost, late, mutilated, illegible or incomplete entries. All entries become the sole property of the Miller Brewing Company (“Sponsor”) and will not be returned.
3. RANDOM DRAWINGS TO DETERMINE 99 SEMI-FINALISTS AND EVENT TO DETERMINE ONE (1) GRAND PRIZE AND ONE (1) FIRST PRIZE WINNER: A random drawing for five (5) Semi-Finalists will be conducted from entry method 2(A), a random drawing for ten (10) Semi-Finalists will be conducted from entry method 2(B) and a random drawing for forty (40) Semi-Finalists will be conducted from entry method 2(D) on or about 08/13/08 by WKSM, an independent judging organization whose decisions on all matters relating to this sweepstakes are final. Semi-Finalists will be notified by phone or mail within two (2) days following the drawing date. All ninety-seven (97) Semi-Finalists from Rules 2(A), 2(B), 2(C), and 2(D) will be required to attend the Miller Better Bolder Summer Sweepstakes Grand Prize Event (the “Grand Prize Event”) on or about 08/20/08 in Fort Walton Beach, FL. Transportation to and from the Grand Prize Event and all other expenses are the sole responsibility of Semi-Finalist. WKSM will conduct a random drawing for two (2) Semi-Finalists from entry method 2(E) at the Grand Prize event. A reverse random drawing for the Prize winners will be conducted at the Miller Lite Better Bolder Summer Sweepstakes Event from among the ninety-nine (99) Semi-Finalists by WKSM. The second to last Semi-Finalist drawn will be considered the First Prize Winner and the last Semi-Finalist drawn will be considered the Grand Prize winner, subject to verification.
4. PRIZE AND APPROXIMATE RETAIL VALUE: One (1) Grand Prize: prize includes one (1) 2008 Harley-Davidson® XL 1200N Sportster® 1200 Nightster® motorcycle (ARV $10,000.00). Prize consists only of the item specifically listed as part of the prize and does not include additional options, license, insurance, title, registration fees and taxes. Winner must take delivery of prize at a Harley-Davidson® dealership as designated by Sponsor. One (1) First Prize: prize includes one (1) Miller Lite/Harley Davidson Leather Jacket (ARV $200). Prize consists only of the item specifically listed as part of the prize. Odds of becoming a Semi-Finalist depends on the number of eligible entries received. Odds of a Semi-Finalist winning First Prize 1:99. Odds of Semi-Finalist winning Grand Prize 1:99.
5. GENERAL RULES: This sweepstakes is open to residents of FL who are of legal drinking age at time of entry. Employees of Miller Brewing Company, MillerCoors, LLC, SABMiller plc, Harley-Davidson Motor Company, Inc., and their representatives, affiliates, subsidiaries, distributors, advertising and promotion agencies, alcohol beverage retailers, their immediate family members and/or those living in the same household of each are NOT ELIGIBLE. This sweepstakes is void in CA and where prohibited by law, and is subject to federal, state and local laws and regulations. All federal, state and local taxes are the sole responsibility of winners. The potential Grand Prize winner will be required to execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance form within five (5) days of attempted notification. Return of any prize notification as undeliverable will result in disqualification and an alternate will be selected. By accepting prize, winners agree to hold Miller Brewing Company, SABMiller plc, MillerCoors, LLC, Harley-Davidson Motor Company, Inc., Collaborative Marketing Group, Inc., WKSM, their distributors and alcoholic beverage retailers, affiliates, subsidiaries, advertising and promotion agencies, as well as their respective affiliates, officers, directors, agents, employees and assigns, harmless against any and all claims arising out of use or misuse of prize and acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability, except in regard to Sponsor and the standard written warranty statement provided with the motorcycle. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission to use winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the official rules and the decisions of the Sponsor. No substitution or transfer of prize permitted, except Sponsor reserves the right to award a prize of equal or greater value. In the event Miller is prevented from continuing with this promotion, or the integrity and/or feasibility of the promotion is severely undermined by any event beyond Miller’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Miller’s control (each a “Force Majeure” event or occurrence), Miller shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the promotion without further obligation. If Miller, in its discretion, elects to abbreviate the promotion as a result of a Force Majeure event, Miller reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event, in a random drawing. In no event will more prizes be awarded than stated in Rule #4. 1) WKSM allows only one winner per household in a two week (14 day) period. With the exception of special contests which can have only one winner per family, per household for the duration of the contest. If you or a member of your household has already won a prize from WKSM within the past two weeks (14 days), WKSM reserves the right to award subsequent prizes.
2) Prizes must be picked up in person at the WKSM/99ROCK business office between 9:00 a.m. and 5:00 p.m. (Mon-Fri, excluding holidays) within ten business days. Claimants must provide proper identification at time of claiming prize. Prizes not claimed within ten business days will be forfeited.
3) Winner is personally responsible for all applicable taxes, and prizes are awarded “as is.”
4) All contests are open to the general public except for employees, agents, subsidiaries and affiliates of WKSM, Cumulus Broadcasting, Inc., participating sponsors, their immediate families and household members.
5) WKSM reserves the right to impose age limits on contest participants, to substitute a prize of equal value and to end a contest at any time without prior notice.
