Official Promotional Rules WKSM/99ROCK “PIGSKIN CLASSIC” Contest
WKSM/99ROCK will conduct the “99ROCK Pigskin Classic” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:
1. No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
2. Must be a legal U.S. resident at least 18 years of age in order to participate in and win the Contest.
3. The Contest is open to the general public, except for employees, agents, representatives or affiliates of WKSM/99ROCK, Cumulus Broadcasting LLC, Best Buy, Buffalo Rock Pepsi, other participating sponsors (collectively the “Contest Sponsors”), all other radio industry employees, and their immediate family members. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others. To be eligible listeners must have a valid social security number and working telephone number when qualifying and at the time they are selected as a prize winner; individuals who do not satisfy these eligibility and other requirements will be declared ineligible to win the Contest.
4. An individual may win an on-going contest only once per 6 month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest. Only one qualifier will be allowed per family or per household for the duration of the Contest. Any individual who has previously won a prize or a combination of prizes valued at more than $600 from any Cumulus station within the past year is not eligible to participate in the Contest.
5. The Contest will run from Thursday, January 14, 2010 and end on Thursday, February 4, 2010 (the “Contest Period”).
6. One grand prize of a 42-inch Insignia Plasma HDTV (valued at approximately $550), food for winner’s Big Game party and 9 cases of Pepsi Max (valued at approximately $108) will be awarded.
7. Listeners can qualify for the Contest by participating in the 99ROCK Pigskin Classic competition remotes as announced on-air in advance (date/time/location). At each remote, participants will have 3 chances to toss the “Pigskin” – the bag of pork rinds through the 99ROCK target from 10 feet away as marked on location. Any listener who successfully tosses the “Pigskin” through the target automatically qualifies the participant for the prize PROVIDED THAT HE OR SHE FULLY COMPLETE THE 99ROCK REGISTRATION FORM AT THE EVENT. Each contestant may only compete in the Pigskin Classic one time at each remote. The competitions will take place only during the scheduled times for the remote broadcast, on a first-come, first serve basis. ONLY ONE ENTRY PER PERSON WILL BE ACCEPTED AT EACH REMOTE. On Thursday, February 4, 2010, a random drawing will be held from all qualifiers who successfully tossed the “Pigskin” through the target at any of the competition remotes. That person’s name will be announced on the air and contacted via phone using the information from his/her entry form. Provided that he/she meets all of the above eligibility requirements, he/she will be declared the winner.
8. If it is determined that the entrant selected is not eligible to win the Grand Prize, in the station’s judgment and discretion, another random drawing will be held and this process will continue on until such time as an eligible entrant is found. In the unlikely event that no entrant is found to meet the specifications, then the Grand Prize will go un-awarded. In the event of a tie, the winner will be determined by and at WKSM/99ROCK’s discretion. The Winner’s name may or may not be announced on the air.
9. All those who win a prize or combination of prizes valued at more than $600 during a calendar year will be issued an IRS Form 1099 to report their winnings. All those who win a prize or combination of prizes valued at more than $600 on any Cumulus Broadcasting station will not be eligible to win another prize or combination of prizes of equal or greater value for one year thereafter.
10. All prizes are awarded “as is.” Prizes are nontransferable and cannot be sold, exchanged or redeemed for prizes or cash.
11. Odds of winning depend on a number of factors including the number of entrants attempting to participate, and the number of correct guesses submitted on eligible entries received.
12. WKSM/99ROCK shall not be responsible for the failure of participating sponsors to deliver prizes or any part thereof as described herein.
13. All entrants and winners agree that WKSM/99ROCK, Cumulus Broadcasting LLC, and their parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.
14. All prizes must be claimed in person at WKSM/99ROCK during regular business hours and within ten (10) business days of winning. After such time, ownership of said prize reverts to WKSM/99ROCK to be disposed of at its discretion. The winner then loses all claims and rights to said prize.
15. Proper identification must be presented by any winner to claim a prize. As a condition to receiving the prize, any potential winner must complete a prize fulfillment package and sign a Winner’s Affidavit and Release, releasing WKSM/99ROCK, Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize. This information will be notarized and copies provided to the contest winner and the station’s corporate office in Atlanta, GA.
16. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of WKSM/99ROCK to be used, disposed of or destroyed at the discretion of the station. Further, WKSM/99ROCK is not responsible for lost, mutilated, illegible, misdirected, late, stolen, incorrect or incomplete entries.
17. All entrants and winners agree to give WKSM/99ROCK and Cumulus Broadcasting LLC, and their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason WKSM/99ROCK deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to save harmless WKSM/99ROCK, Cumulus Broadcasting LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against WKSM/99ROCK or Cumulus Broadcasting LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live. All winners further acknowledge that Cumulus Broadcasting LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Broadcasting LLC.
18. By participating in the Contest, each participant agrees to receive email communications from WKSM/99ROCK regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest. By participating in the Contest, where allowed by law, participants agree that WKSM/99ROCK may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
19. By participating in the Contest, participants agree to be bound by the decisions of WKSM/99ROCK personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. WKSM/99ROCK will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and WKSM/99ROCK’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of WKSM/99ROCK, WKSM/99ROCK reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as WKSM/99ROCK deems appropriate. All decisions will be made by WKSM/99ROCK are final. WKSM/99ROCK may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
20. WKSM/99ROCK reserves the right to end a contest at any time upon advanced notice to the public
21. WKSM/99ROCK reserves the right to limit the number of times an individual may enter a contest or drawing.
22. WKSM/99ROCK reserves the right to require contestants or their representative via written proxy to be present at drawings in order to win their prize.

99ROCK-WKSM General Contest Rules
1) WKSM allows only one winner per household in a two week (14 day) period. With the exception of special contests which can have only one winner per family, per household for the duration of the contest. If you or a member of your household has already won a prize from WKSM within the past two weeks (14 days), WKSM reserves the right to award subsequent prizes.
2) Prizes must be picked up in person at the WKSM/99ROCK business office between 9:00 a.m. and 5:00 p.m. (Mon-Fri, excluding holidays) within ten business days. Claimants must provide proper identification at time of claiming prize. Prizes not claimed within ten business days will be forfeited.
3) Winner is personally responsible for all applicable taxes, and prizes are awarded “as is.”
4) All contests are open to the general public except for employees, agents, subsidiaries and affiliates of WKSM, Cumulus Broadcasting, Inc., participating sponsors, their immediate families and household members.
5) WKSM reserves the right to impose age limits on contest participants, to substitute a prize of equal value and to end a contest at any time without prior notice.
